Open Meetings & Notice Requirements

Arizona requires HOA boards to conduct business transparently. Here's what the law says and what to watch for.

Key Requirements (A.R.S. § 33-1804)
  • Board meetings must be open to all members
  • Notice must be given at least 48 hours in advance (posted in a conspicuous place)
  • Members have the right to speak at meetings
  • The board can only go into executive session for limited purposes (legal advice, personnel, specific owner violations)
  • Meeting minutes must be maintained and made available

Red Flags to Watch For
  • Meetings held without proper notice
  • Board conducting business via email or "serial meetings" to avoid open meeting requirements
  • Excessive use of executive sessions
  • Refusing to allow member comment periods
  • Minutes that don't reflect what actually happened
